Planning and the two-map test

Town policy and Escarpment control answer different questions

The short version

Start with the Town Official Plan and zoning, then check the Niagara Escarpment Plan and Area of Development Control. A parcel can need NEC permission before municipal approvals, while conservation and County roles remain separate.

The Town has multiple planning geographies

Official Plan schedules separately map Thornbury-Clarksburg, Lora Bay, Camperdown, Craigleith-Swiss Meadows, Blue Mountain Village and Castle Glen.

Identify the legal parcel and every applicable secondary plan, zoning category, holding provision and current application.

NEC approval is not municipal approval

The NEC states that most development or changes of land use in development control require its permit. Municipal building and other approvals may also be required and can only follow the NEC permit where applicable.

A listed use is not necessarily permitted as of right; criteria, conditions and agency review matter.

Current and draft policy must stay separate

The Town is updating its Official Plan and design guidelines. Consultation material can signal direction without changing the bylaw in force.

Record the adoption and appeal status at the transaction date, and state future policy as uncertainty.
